BBSG Buyer Terms Of Use

The following provides important information regarding the scope of the Limited Warranty, responsibilities of the Builder and Buyer under the Limited Warranty, and conditions for using the BBSG website. PLEASE READ CAREFULLY.

LIMITED WARRANTY SCOPE
1. The Limited Warranty is extended by the Builder who is the warrantor. NO OTHER PARTY, INCLUDING THE BUILDER/BUYER SERVICES GROUP, SHALL HAVE OBLIGATIONS OR LIABILITIES WHATSOEVER.
2. The Limited Warranty is extended by the Builder to the original Buyer and, unless otherwise stated in the Warranty Acknowledgment form provided to the Buyer, is not transferable to any subsequent buyer of the home.
3. Subject to the exceptions and exclusions described in the Limited Warranty, the Builder shall address warranted items for which a defect is discovered during the warranty period. Items and conditions not specifically covered by this warranty are excluded from coverage and are the responsibility of the Buyer.
4. Conditions discovered during the warranty period, and any actions taken to address said conditions, shall not act to extend the duration or provisions of the Limited Warranty.
5. The Limited Warranty is defined by any provisions established in the sale contract and the generic materials provided by BBSG and adopted by the Builder. Should a conflict exist between materials provided by BBSG and the sale contract, the provisions of the sale contract shall govern.
6. THIS LIMITED WARRANTY IS THE ONLY EXPRESS WARRANTY EXTENDED TO THE BUYER BY THE BUILDER, AND IS IN LIEU OF ANY AND ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND HABITABILITY. Any implied warranty that exists despite this disclaimer is limited to a period of one (1) year from the Commencement Date. (Some states do not allow limitation on how long an implied warranty lasts, so this limitation may not apply.)
7. Certain components in the home have warranties provided by the manufacturer. Manufacturer warranties for these components are assigned to the Buyer upon closing and the Builder assumes no further obligations under the Limited Warranty.
8. THIS LIMITED WARRANTY EXCLUDES ANY INJURY TO PERSONS OR DAMAGES TO PERSONAL OR REAL PROPERTY, IN WHOLE OR PART, THAT MAY BE A CONSEQUENCE OF, OR INCIDENT TO, OR RESULT FROM ANY DEFECTS IN MATERIALS OR PERFORMANCE OF THE WORK. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS EXCLUSION OR LIMITATION MAY NOT APPLY.
9. This warranty gives you specific legal rights, and you may also have other rights, which may vary from state to state.

RESPONSIBILITIES
1. The Limited Warranty is managed by the Builder/Buyer Services Group. As such, BBSG serves as the communications conduit between the Buyer, the Builder, and the Sub-Contractors.
2. The Buyer is solely responsible for initiating requests for service under the Limited Warranty.
3. All requests for service under the Limited Warranty must be submitted via the BBSG website VERBAL REQUESTS FOR SERVICE WILL NOT BE ACCEPTED.
4. While BBSG notifies the Sub-Contractors of authorized work to be done, the Buyer is responsible for scheduling service appointments.
5. THE BUILDER SHALL NOT BE RESPONSIBLE FOR ADDRESSING CONDITIONS WHERE, AFTER REASONABLE ATTEMPTS, THE HOME IS NOT MADE ACCESSIBLE FOR INSPECTION AND/OR REPAIRS DURING NORMAL BUSINESS HOURS.
6. Except for conditions meeting the criteria of Emergency or Immediate Action, service requests should be submitted only during the service windows defined by the Builder.
7. Except for conditions meeting the criteria of Emergency or Immediate Action, the Builder shall initiate appropriate action on warrantable conditions within ninety (90) days after receipt of a service request, weather and labor conditions permitting.
8. THE BUILDER IS NOT OBLIGATED TO REIMBURSE THE BUYER FOR UNAUTHORIZED REPAIRS OR EXPENSES.
9. The Builder is responsible for addressing only those qualifying conditions discovered during the warranty period for which timely notification is made. Service requests received after the warranty end date will be denied.

CONDITIONS FOR WEBSITE USE
Any of the following situations will result in the revocation of Buyer privileges on the BBSG website, with or without prior notification.
1. Use of inappropriate language.
2. Unprofessional remarks directed at the Builder (including Builder representatives and subcontractors) or BBSG (including the company and company affiliated representatives).
3. Repeated submittal of non-emergent issues as an Emergency or Immediate Action service request.
4. Any use of this website for purposes other than those intended by BBSG.

WEBSITE DISCLAIMERS
1. BBSG is not responsible or liable for conditions or situations resulting from the disruption of Internet service.
2. BBSG is not responsible or liable for the content or accuracy of responses, status reports, comments, or other input provided by Builders or Subcontractors.
3. BBSG may respond to your phone or text inquiries by text. Charges may apply, depending on your mobile service carrier and your service plan. Reply to any BBSG text with STOP to prevent future texts, or contact the BBSG office by phone.
